3.37- What are the Actions an MLO should take when a borrower refuses to provide ethnic, race or gender information • Truth-in-Lending Act (TILA), 12 CFR Part 1026 (Regulation Z) ?
If the borrower refuses to give information on race, ethnicity and gender, the MLO should fill that form based upon the visual observation and surname. The MLO should place a note on the application that the borrower declined to answer the question.
